Expanding Opportunities for Tennessee’s Independent Contractor Workforce with Portable Benefits

Technology has rapidly transformed employment and given workers new opportunities to join the growing “gig” or independent contractor workforce. Tennessee has more than one-half million self-employed and independent contractors. While these individuals have chosen this work for many reasons, state law restricts companies from providing employment benefits to them.

      State laws are attempting to catch up to technology by allowing portable benefits laws. These benefits, usually in the form of cash, are given to independent contractors and are retained by the workers to be utilized as they prefer through a third-party administrator. These benefits may include paid leave, healthcare, or any other that is offered to full-time employees.

      Independent contractors value the flexibility of their work choices, and this legislation will enhance completely voluntary opportunities for companies to offer them portable benefits. The success of portable benefits in other states has led to an expansion of benefits to independent workers while maintaining their employment flexibility. Under this proposed legislation, companies and independent contractors will have the opportunity to provide and receive the same benefits as traditional workers.
